Membership Agreement and Terms of Use
Validity of the agreement
To shop at the online store of the company referred to in this agreement as "sales@lapitek.com", you must complete the membership registration form and obtain a user account and password on the online store. (Natural or legal persons who complete the registration form and obtain a password are referred to in this agreement as the "member".)
Once the member has successfully completed registration and from the moment they use the system to receive any service or place an order, they are deemed to have undertaken to comply with the sales@lapitek.com agreement.
Description of services
sales@lapitek.com offers members who accept this agreement various online communication services (such as voting, gift notes, comments and recommendations, announcement requests, promotion notifications) and the opportunity to shop electronically.
Return conditions
a. Returns are not accepted for special orders or products personalised at the member’s request. Unless defective or damaged, such products fall within the exceptions to the right of withdrawal under applicable consumer protection legislation.
Online store membership system
The member has a "password" of their own choosing on the sales@lapitek.com online store.
The e-mail address provided at registration is unique to the member and only one membership may be created with it; two separate memberships cannot exist with the same e-mail address.
The "password" is known only to the member, who may change it at any time. Choosing and safeguarding the password is entirely the member’s responsibility. sales@lapitek.com is in no way liable for problems arising from use of the password.
To access services that require sales@lapitek.com membership, the member must enter the e-mail address and password provided at registration. This is defined as "member login" to sales@lapitek.com.
Member obligations
• While using sales@lapitek.com services, the member accepts that the information on the registration form is correct and that they are responsible for damage arising from incorrect or incomplete information when such information is required (e.g. forgotten password), and that membership may be terminated in such cases,
• That copyright in services and software provided by sales@lapitek.com belongs to sales@lapitek.com, that they will not copy or distribute such software in any way, that they are responsible for personal opinions, expressions, uploaded files and personal data submitted while using sales@lapitek.com services and that sales@lapitek.com cannot be held liable for such content, and that the member must bear all damage that may arise if such situations occur,
• That sales@lapitek.com is not responsible for information, messages or files that are lost, incompletely received, or sent to the wrong address during use of the services,
• That they will not access services on lapitek.com in an unauthorised manner or in a form other than that determined by sales@lapitek.com, will not modify the software in any way, will not use software that is evidently modified, and will compensate sales@lapitek.com for all material and moral damage it may suffer if they fail to comply,
• That sales@lapitek.com is not liable for damage that may arise if member data is read by unauthorised persons,
• Not to send threatening, immoral, racist messages or messages contrary to the laws of the Republic of Turkey or international agreements,
• That posts, subject lines and nicknames added to the environment comply with general morality, decency and legal rules, and not to behave in a way that prevents other users from using the service,
• Not to publish, print or distribute material or information that defames, disparages or is immoral, improper or unlawful regarding persons or institutions,
• Not to advertise, sell or offer to sell any goods or services, or conduct surveys, contests or chain letters,
• Not to send information or programs that could damage other users’ computer data or software,
• That any records or materials obtained through sales@lapitek.com services are entirely with the member’s consent, that they are fully responsible for malfunctions, data loss and other losses on their computer, and that they will not claim compensation from sales@lapitek.com for damage they may suffer from use of the service,
• Not to use sales@lapitek.com services for commercial or advertising purposes without permission from sales@lapitek.com,
• That sales@lapitek.com may monitor the entire system at any time or on an ongoing basis,
• That if they act contrary to the rules, lapitek.com has the right to intervene as necessary, remove the member from the service and terminate membership,
• That sales@lapitek.com may use its system for commercial purposes,
• Not to post information whose publication is prohibited by law and not to distribute unauthorised mail such as chain letters or software viruses,
• Not to record or misuse personal information belonging to others,
• That the member is personally responsible for all actions taken using the e-mail address stated at registration,
• That when collecting goods purchased, the member must show valid ID if requested, allow relevant identity details to be recorded and sign where required; if they do not sign, the product may not be delivered to them,
• If the product is collected by someone else, the person collecting must sign a document they can present to sales@lapitek.com confirming that they know the person who sent the product; if the document is not signed, delivery may be refused and the order may be deemed not to have been fulfilled
and accepts and undertakes the foregoing.
Within the scope of the powers granted, sales@lapitek.com may suspend operation of the system temporarily or stop it entirely at any time. It shall have no liability to members or third parties for temporary suspension or complete shutdown of the system.
The e-mail address and password entered by the member at registration will be displayed and confirmed after the customer completes the application fields offered by sales@lapitek.com. sales@lapitek.com may indefinitely prevent members who have completed all fields or who have a password from obtaining a new password or using their password when connecting.
sales@lapitek.com does not guarantee that services will be provided on time, securely and without error, that results obtained from use of the services are accurate and reliable, or that service quality will meet expectations. sales@lapitek.com owns the property and copyright arising from ownership in information, documents, software, designs, graphics and similar works it produces and/or acquires from third parties.
sales@lapitek.com may not deliver products that are out of stock, may cancel the order and refund the order amount to the customer account.
Display of products in the online store does not mean sales@lapitek.com guarantees they are in stock. sales@lapitek.com has the right to publish and/or move to another address on the site, as it sees fit, information, documents, software, designs, graphics and similar works that members produce and voluntarily upload to the system (e.g. messages, poems, news, files added to a board). It is possible that such published information may be copied and/or republished by other users. In such cases the member will not claim any copyright fee from the sales@lapitek.com online store.
sales@lapitek.com is fully authorised to allow personal information transmitted by the member to be used by content providers and web service users for necessary communication, promotion, delivery of goods, advertising and similar commercial purposes. Without the customer’s approval, sales@lapitek.com may support or itself carry out advertising and promotional activities directed at members using their information, including companies whose products are listed in the online store.
sales@lapitek.com is entitled to change the price and product specification information of products offered for sale. If there is an error in price or product specifications, sales@lapitek.com may deliver the product after correcting the error or cancel the order and refund the order amount to the customer account. sales@lapitek.com may enable the member to move to other websites. In that case the member accepts that sales@lapitek.com is not responsible for the content of sites they visit.
sales@lapitek.com may make changes in the application of this agreement for future technical necessities and compliance with legislation, and may amend existing clauses or add new ones. In that case the member must approve the contract changes by clicking the relevant button in order to continue using the services. sales@lapitek.com may over time convert services that did not require membership into membership-required services, open additional services, and partially or wholly change certain services or make them paid.
Personal and non-commercial use restriction
Members accept that all purchases are for personal use and are not for resale.
Taxation
Transactions arising from statutory changes outside the scope of this agreement are outside the responsibility of sales@lapitek.com and are reflected in the agreement as they stand.
Product delivery
If the member is not at the address specified in the system during carrier delivery, the carrier leaves a visit notice. If the member requests within three days, delivery is made again to the same address for a fee. If the member does not request within three days, the product order is deemed not to have been placed. Even then, after the shipping fee is charged to the customer’s credit card account, a refund is made to the customer.
Product returns
Provisions of applicable consumer protection law apply to product returns.
The member accepts, declares and undertakes that in disputes arising from this agreement, the books, microfilm, microfiche and computer records of sales@lapitek.com shall constitute valid, binding, conclusive and exclusive evidence within the meaning of applicable procedural law, that this clause is an agreement on evidence, that they waive in advance the right to offer an oath regarding lapitek.com records and proper keeping of such records.
Applicable provisions
In disputes arising from this agreement, the provisions of this agreement apply first; where there is no provision, the laws of the Republic of Turkey apply (Civil Code, Commercial Code, Code of Civil Procedure and others as applicable).
Competent courts and enforcement offices
Istanbul Courts and Enforcement Offices shall have jurisdiction over any dispute arising from the application of this agreement.
Entry into force
This agreement enters into force between the parties indefinitely once the member completes the registration form and uses the system to receive services or place orders.
Termination: sales@lapitek.com may terminate this agreement at any time.
